These Terms of Service ("Terms") govern your access to and use of the Drive Service Network platform at driveservicenetwork.com (the "Platform"), operated by Drive Commerce Inc. ("Drive Commerce," "we," "us," or "our"). Drive Service Network is a Drive Commerce Inc. platform within the Global Drive Holdings ecosystem.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
Drive Service Network is a service connection platform that connects vehicle owners and fleet operators ("Clients") with independent automotive service providers ("Providers"). Drive Service Network is a platform intermediary only — we do not employ Providers, perform automotive services, or guarantee the quality of services delivered by Providers in our network. The actual service relationship is between the Client and the Provider.
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
When you submit a service request through the Platform, you authorize Drive Service Network to share your contact information and service request details with matched service providers in our network. Submission of a service request does not guarantee that a provider will be available or that service will be performed. Drive Service Network will make reasonable efforts to connect you with a qualified provider but does not guarantee provider availability.
Drive Service Network acts as an intermediary platform only. We do not perform automotive services, employ service technicians, or guarantee the workmanship, quality, or outcome of any services performed by Providers. All service agreements, pricing, warranties, and disputes regarding actual automotive service are between the Client and the Provider. Drive Service Network is not a party to the service transaction.
Providers in our network are independent businesses that have been vetted and approved by Drive Service Network. While we maintain standards for network participation, we do not guarantee the performance of any individual Provider. Providers are independent contractors, not employees or agents of Drive Service Network.
You agree not to use the Platform for any unlawful purpose, to submit false or misleading service requests, to attempt to circumvent the Platform's matching process, to harass or abuse service providers or Platform staff, or to interfere with the operation of the Platform.
The Platform and all content, features, and functionality are owned by Drive Commerce Inc. and its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on the Platform without our express written permission.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DRIVE SERVICE NETWORK DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRIVE SERVICE NETWORK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY SERVICES OBTAINED THROUGH THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in Florida.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.
